These Terms of Service (“Terms”) are a legal agreement between you and The Colosseum (“The Colosseum,” “we,” or “us”) governing your use of thecolosseumapp.com and any related services (the “Service”). Please read them carefully — by using the Service you agree to be bound by them.
1 · Who can use the Service
You must be at least 18 years old to create an account. If you are using the Service from a U.S. state that imposes a higher minimum age for paid contests (for example, 21 in some jurisdictions), you must meet that age. You must also be legally able to enter into binding contracts where you live.
The Service is operated from the United States and is primarily intended for U.S. residents. If you access the Service from outside the U.S., you do so at your own risk and you are responsible for compliance with local laws.
The Service is offered for personal, non-commercial use only. You may not use the Service to run a competing business, to scrape data, or to operate automated agents (other than the standard search-engine crawlers we permit via robots.txt).
2 · Your account
To participate in most features of the Service you need an account. You agree to provide accurate information when you sign up, to keep it updated, and to keep your password (or OAuth credentials) secure. You are responsible for any activity that occurs under your account. If you suspect unauthorized access, contact us at hello@thecolosseumapp.com immediately.
You may delete your account at any time from your profile settings, subject to the data-retention rules in our Privacy Policy.
3 · Pools, contests, and prize disbursement
The Service lets you organize and participate in pools, contests, and games (collectively, “Pools”). Each Pool has its own rules — buy-in amount, scoring system, payout structure, registration deadlines — which are published on the Pool's page and which you agree to follow when you enter.
Payments are between participants — not through us
At this time, The Colosseum does not process or hold any money for Pool buy-ins or prize disbursements. All payments and payouts are made directly between participants and the relevant Pool operator using third-party services (such as Venmo, Zelle, or in-person cash). We do not collect, store, or transmit your payment information. We are not a party to any payment transaction, we do not act as a financial intermediary, escrow agent, or money transmitter, and we do not guarantee that any Pool participant will pay their buy-in or that any winner will be paid by the Pool operator. Disputes about payment are between you and the other participants.
If and when we introduce platform-handled payments (for example, via Stripe or a similar processor), these Terms will be updated to describe how those payments are processed and what additional rules apply.
Pool rules govern participation
Each Pool's posted rules are part of these Terms with respect to that Pool. If a Pool's rules conflict with these Terms, the Pool's rules govern as to that Pool. Pool operators are responsible for fairly applying their own rules. The Colosseum may, at its sole discretion, intervene in a Pool if we observe behavior that violates these Terms or applicable law.
Fantasy / contest-of-skill posture
Pools offered on the Service are intended to be contests of skill in which entrants compete based on knowledge and judgment of sports outcomes, not games of chance. Some U.S. states regulate or restrict paid fantasy contests, and the legality of participating in a paid Pool depends on where you live. It is your responsibility to confirm that participating in any specific paid Pool is legal in your jurisdiction. Where state law restricts paid contests, we may geo-block paid entries from that state or limit a Pool to no-buy-in (free) entry.
4 · How you can and can't behave on the Service
You agree not to:
- Use the Service for any unlawful purpose, or in violation of these Terms or any Pool's rules;
- Create more than one account per person, or enter the same Pool under multiple identities, unless the Pool's rules explicitly permit it;
- Impersonate another person, misrepresent your affiliation with anyone, or use a false identity;
- Scrape, copy, or systematically harvest data from the Service;
- Reverse-engineer, decompile, or attempt to extract the source code of any portion of the Service;
- Disrupt, attack, or attempt to gain unauthorized access to the Service or to other users' accounts;
- Use the Service to harass, threaten, or abuse other users.
We reserve the right to suspend or terminate any account that violates these rules.
5 · Your content
You retain ownership of any content you submit to the Service (entry names, comments, etc.). By submitting content, you grant The Colosseum a worldwide, non-exclusive, royalty-free license to host, display, and use that content as necessary to operate the Service and to publicize pool results (e.g. showing leaderboards). You represent that you have the right to submit any content you upload and that it does not infringe anyone else's rights.
6 · Our intellectual property
The Service, including its design, code, copy, name, logo, and the “Arena” visual identity, is owned by The Colosseum and is protected by U.S. and international intellectual-property laws. We grant you a limited, non-transferable, revocable license to use the Service for its intended purposes, subject to these Terms. Nothing in these Terms transfers any of our intellectual property to you.
Third-party sports data (team names, schedules, scores, athlete information) is the property of the relevant sports organizations or data providers. We display this data under fair-use or licensed-API arrangements.
7 · Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that any data displayed (including live sports data) will be accurate or up to date.
Sports data is provided by third-party APIs (ESPN, SlashGolf, The Odds API, others). We do our best to display accurate scores, but we do not control those sources. Pool results may be subject to correction if upstream data is later corrected by the relevant sports organization or data provider.
8 · Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COLOSSEUM, ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE — WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO THE COLOSSEUM IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50.
9 · Indemnification
You agree to indemnify and hold harmless The Colosseum and its owners from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your violation of these Terms or any Pool's rules, (c) your violation of any third-party right (including intellectual property and privacy rights), or (d) your participation in any Pool, including any dispute with another participant about a buy-in or payout.
10 · Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at our discretion if you violate these Terms, abuse the Service, or for any other reason where we believe termination is appropriate. Sections that by their nature should survive termination (e.g. Disclaimers, Limitation of Liability, Indemnification, Governing Law) will survive.
11 · Governing law and disputes
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. You and The Colosseum agree to submit to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois for the resolution of any dispute that cannot be resolved informally.
Before filing any lawsuit, you agree to first contact us at hello@thecolosseumapp.com and attempt to resolve the dispute informally for at least 30 days.
12 · Changes to these Terms
We may update these Terms from time to time. When we do, we'll update the “Last updated” date at the top of this page, and for material changes we'll notify you by email or via a prominent notice in the Service before the changes take effect. Your continued use of the Service after a change indicates your acceptance of the updated Terms.
